Judicial Panel to Reconsider Ruling That Permitted Former President to Send Military Forces to Portland

Appeals Court Agrees to Reconsider Case

The federal appeals court decided on Tuesday that it would reexamine the case concerning the president’s authority with an expanded group of 11 judges. The judicial body also overturned a previous ruling from a three-judge panel that had supported the administration.

This legal directive represents the latest turn in a long-running court case over whether the former president has the authority and justification to send national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the mobilization attempt was started in response to ongoing demonstrations.

Differing Viewpoints

The federal government has claimed that federal officials at the ICE facility in south Portland were facing threats, while city and state officials assert that local officers have control of the circumstances.

Contrary to descriptions of the city as “war ravaged”, locals have been sharing footage of lush hiking trails and a thriving food scene, and organizing activities such as an protest bicycle event against the “militarization of our city”.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland enacted two temporary restraining orders this period – one preventing the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after efforts to evade the first order by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the troops.

Full Panel Consideration

The latest ruling means the issue will be heard “en banc” – with all decisions under review together – by a group of eleven justices.

“This ruling demonstrates that facts are important and that the courts are striving to ensure government responsibility. The founding document limits the executive authority, and local populations cannot be treated as a training ground for unchecked federal authority,” said the legal representative in a official comment.

“The judicial body is sending a clear message: the president cannot dispatch the military into American urban areas without cause. We will continue defending state legislation, values, and sovereignty as this legal proceeding progresses and our fight continues in the judicial system.”
